By accessing or using the website at yuccavalleyfenceanddeck.com, or by engaging Yucca Valley Fence & Deck for any services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
These Terms and Conditions apply to all visitors, customers, and others who access our website or request services from Yucca Valley Fence & Deck.
Yucca Valley Fence & Deck provides residential outdoor construction services, including but not limited to deck design and construction, composite deck installation, fence installation, pergola installation, patio covers, and related services in Yucca Valley, CA and surrounding communities.
Our website provides general information about our services, service areas, and contact methods. It is not a binding contract or guarantee of service availability. All services are subject to a written proposal and signed contract between Yucca Valley Fence & Deck and the customer before work begins.
Free on-site estimates are offered without obligation. An estimate or verbal quote does not constitute a binding contract. A written proposal sets out the scope of work, materials, and price for a specific project.
Prices are subject to change if the scope of work changes after the proposal is accepted. Any changes to the scope of work must be agreed to in writing by both parties before additional work begins. We will not charge for work outside the original written scope without your prior written approval.
Material costs are subject to market fluctuations. In the event of a significant increase in material costs between proposal acceptance and project start, we will notify you and obtain your written approval before proceeding.
Project start dates are estimates based on current workload and permit timelines. Delays may occur due to weather, permit review timelines, material availability, or other circumstances outside our control. We will communicate any significant delays to you as soon as we are aware of them.
If you need to cancel or reschedule a project, please notify us as soon as possible in writing. Cancellation terms, including any applicable deposits or cancellation fees, are specified in your written project contract. In general, deposits may be non-refundable once materials have been ordered or permits have been submitted on your behalf.
Payment terms are outlined in your written project contract. Typical payment schedules include a deposit at contract signing, progress payments at defined project milestones, and a final payment upon project completion and your satisfaction.
Final payment is due upon completion of the project and passing of any required inspections. Accounts not paid within the time frame specified in the contract may be subject to late fees as stated in that contract. Yucca Valley Fence & Deck reserves the right to suspend work on a project if payments are not made as agreed.
Where a building permit is required by local authorities, Yucca Valley Fence & Deck will apply for and manage the permit process on your behalf as part of the project agreement. Permit fees are the responsibility of the customer and will be itemized in your project contract.
You agree to provide reasonable cooperation and access to your property to allow required inspections by local building officials. Final payment may be conditioned on the project passing all required inspections.
You are responsible for ensuring clear access to the work area before the project start date, including removing personal property, vehicles, plants, and any obstructions from the area where work will be performed. Failure to provide reasonable access may result in project delays or additional charges for time lost.
You are responsible for notifying us of any underground utilities, irrigation systems, or other sub-surface features in the work area. Yucca Valley Fence & Deck is not liable for damage to undisclosed or unmarked sub-surface features.
If your property is subject to homeowners association (HOA) rules, you are responsible for obtaining any required HOA approvals before work begins. Yucca Valley Fence & Deck can assist with HOA documentation but is not responsible for delays caused by HOA review processes.
Workmanship warranty terms are specified in your written project contract. Material warranties are provided by the manufacturers of the products used and are passed through to you to the extent permitted by those manufacturers.
Warranties do not cover damage caused by misuse, neglect, natural disasters, modifications made by parties other than Yucca Valley Fence & Deck, or conditions outside normal residential use. Warranty claims must be submitted in writing to projects@yuccavalleyfenceanddeck.com.

To the fullest extent permitted by applicable law, Yucca Valley Fence & Deck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or from any services provided, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to services provided shall not exceed the amount you paid to us for the specific project to which the claim relates.

If a dispute cannot be resolved informally, the parties agree to first attempt mediation through a mutually agreed mediator before pursuing any other legal remedy. Any legal action not resolved through mediation shall be submitted to binding arbitration under the rules of the American Arbitration Association, unless both parties agree otherwise in writing.
